Terms

Short, because the service is short. Nothing here is a surprise, and nothing here is written to be skipped.

1. What we provide

Access to the Pear Metrics application, hosted and maintained by us, measuring traffic on the website you nominate and joining it to spend from the ad accounts you connect.

2. What it costs

Per site, per month, in USD, billed in advance, in the band your monthly event volume falls into. The bands are published in full on the pricing page and start at $59. An event is a pageview or a custom event. The free tier is up to 25,000 of them a month, one site and 1 connected ad account. Every paid band includes 2; each additional one is $15 per month. Annual billing is twelve months for the price of ten.

Going over the band’s ceiling does not generate an overage charge. New events stop being recorded until the calendar month rolls over or the site moves up a band, and data already collected is not deleted or withheld.

Prices may change with 30 days’ notice, never mid-term on an annual plan. Taxes are added where applicable.

3. Your trial

Every account starts with 14 days of the full product, no card. When it ends, the account moves to the free tier rather than being closed, and keeps working within that tier's limits until a band is chosen.

4. Your responsibilities

  • Have the right to measure the website you nominate, and to connect the ad accounts you connect.
  • Tell your visitors what you collect, in your own privacy policy. We provide the paragraph; publishing it is yours.
  • Do not put personal data into custom event properties. It is the one route by which personal data can enter the system, and it is entirely under your control.
  • Keep your account credentials to yourself.

5. Our responsibilities

  • Keep the service running, and keep it patched.
  • Take encrypted nightly backups and verify restores quarterly.
  • Process your visitors’ data only as the data processing agreement allows.
  • Never sell, share, aggregate, benchmark or train on your data, and never pass it to a third party beyond the published sub-processors.

6. Availability

We target 99.9% monthly availability, excluding scheduled maintenance announced at least 48 hours in advance. There is no financial SLA at this price. If a month falls materially short, ask and we will credit it.

Ingest is designed to fail safe: if the application is unavailable, page views are lost rather than queued. Analytics data is not a transaction log and we will not pretend otherwise.

7. Your data

It is yours. Export it at any time as CSV from the dashboard. On cancellation you keep dashboard access for 30 days to export what you want, then the account and its data are deleted. No exit fee.

8. Ending it

Cancel whenever, effective at the end of the current billing period. Monthly plans are not refunded pro rata; annual plans are refunded for whole unused months.

We may suspend or terminate for non-payment after notice, or immediately for use that is illegal or that endangers the service. In either case the export window still applies.

9. Liability

The service is provided without warranties beyond those that cannot be excluded by law. Our total liability in any twelve-month period is limited to the fees you paid in that period. Neither side is liable for indirect or consequential loss.

Decisions about where to spend money are yours. The numbers are as accurate as the tagging they depend on, which is why the product tells you when the tagging is wrong instead of averaging over it.

10. Open source

Pear Metrics is built on Umami, which is MIT licensed. That licence covers the upstream code and travels with it. It does not cover the Pear Metrics name or marks, and nothing here grants a licence to the hosted service.

11. Changes and law

Material changes to these terms are notified by email 30 days in advance. The date at the top of this page is authoritative.

Governed by the law of the jurisdiction stated on your order form.
